1. Dispatch Policy
For UK orders your goods will normally be dispatched within 7 days and should arrive Royal Mail 1st class post within 1-2 days. While every effort will be made to ensure that all items shown are available to order we offer no guarantee of availability and this electronic publication does not constitute an offer for sale.

If something is not in stock, we will advise as to when we expect delivery and send it out as soon as we receive it. If we are unable to supply the goods required to your particular specifications, you will be notified as soon as possible after we recieve your order,and you will be offered a full refund or an alternative.

You will be sent confirmation of your order within a few days, by email. It is the customer's responsibility to notify us of any errors or changes required within 2 days of receipt of confirmation.

It is the customer's responsibility to advise us of non-receipt of the confirmation.

If you have any special deadlines for delivery, please call or email us to let us know, and we'll do our best to help. For guaranteed next day delivery we offer Royal Mail Special Delivery service for orders phoned through to us before 12 noon Monday to Friday. There is an additional charge for this service, dependent on the weight of the order.

Should your goods be returned to us as undeliverable by Royal Mail or courier, we will contact you to arrange re-delivery, however we reserve the right to make a further charge to cover our additional postage expense. We take no responsibility for goods lost in transit due to an incorrectly supplied address.

2. Delivery and Tax
Since we only sell on-line, naturally all our web prices are subject to postage and packing, this is explained at the checkout page. International transactions are subject to the exchange rate on the date of transaction. Orders must be paid for by credit card or PayPal.
Delivery to non-European countries may result in import duties payable on receipt of the goods. You will be liable for these duties.

3. Colours, shapes and sizes
The colour of goods may vary slightly from that shown on the website due to limitations of browser software and monitors. Also colour variations are likely to occur due to the nature of natural materials used.

Balloons are printed in such a way that there may be overlaps and gaps in the printing.

4. Guarantee & Returns

If you wish to return any items please contact us first.

your order number
your name
for faulty goods, the nature of the fault

Items are returned at customers own cost and the correct postage must be paid. Refunds are for the order amount minus our incurred postage expense. Statutory rights are not affected. For exchanges, postage is charged at cost - this is calculated at Royal Mail 1st class postage prices by weight.

Should any item purchased from us prove faulty or incorrectly packed, then please return it to us within 28 days of purchase, and cost, including your return 1st class postage expense will be refunded. This does not affect your legal statutory rights.

We reserve the right to charge an admin fee of up to £5 for handling of returned goods sent in contravention of our policies. Goods returned requiring excess postage on receipt will not be accepted and will be returned to sender.

Volume discounted orders are deemed business to business transactions and different terms and conditions apply.

5. Exchanges
We do charge postage at Royal Mail cost for exchanges. This is calculated as the Royal Mail 1st class postage for the replacement item by weight. When sending goods back, please enclose a cheque made out to Polka Party for an amount equivalent to your 1st class cost of sending the goods back to us.

6. Faulty Goods
Should any item purchased from us prove faulty, then please return it to us within 28 days of purchase. Once the fault is confirmed, the goods will be replaced or refunded and your sending 1st class postage expense will be refunded.

7. Incorrectly packaged goods
If you receive goods sent incorrectly, please let us know immediately by email and return the goods to us as per faulty goods. We will send you the correct items by return, and will enclose a cheque to cover your 1st class postage back to us.

Please take your parcel(s) to your nearest post office - we recommend that you send returns by registered post. Please always obtain proof of postage when returning a parcel.

8. Legal statements on returns:
Returning any item within 3 months will be taken as notice of cancellation of your order (or part of your order). Goods are provided to you on approval and legal title to the goods will not pass to you until the three month post-delivery period has expired. On receipt of the goods, we will give you a full refund of the amount paid or an exchange credit as required. On returned goods on which you have received a discount/offer, that discount/offer will no longer apply if you fall below the discount/offer threshold. The contract in respect of sale of goods between Polka Party and you requires that you return the goods to Polka Party on cancellation. The costs of returning goods to Polka Party are borne by you. Orders collected from Polka Party incur no handling charge. Polka Party can arrange for delivery of products to you if required; this constitutes a separate contract between you and Polka Party. In this case, a charge will be made by Polka Party for packing, handling and delivery of goods. Your statutory rights are considerably enhanced by all of this.

9. Confidentiality
All customer details are used only in accordance with the Data Protection Act.
The website www.polkaparty.co.uk is protected by industry standard SSL technology, therefore any information you give us can only be accessed by ourselves, all information is stored on secure servers. We only collect information from customers in order to fulfil orders, we may from time to time contact you by email to inform you of special offers/promotions we are running. We never pass on information about our customers to any third party without your consent but we reserve the right to pass on customer's contact numbers to parcel carriers in the event of delivery difficulties, unless specifically requested not to do so.

10. Indemnity
You agree to indemnify us against any claims, losses, liabilities, damages and expenses (including legal fees), arising out of your use of this site.

11. Jurisdiction
The Contract will be governed by the laws of England and Wales and the parties to the Contract submit to the jurisdiction of the English Courts.

12. Consumer Rights
None of the above Terms and Conditions affects your statutory consumer rights.

13. Terms Of Use
By using this website you agree to be legally bound by these terms, which shall take effect immediately. If you do not agree to be legally bound by all of the following terms please do not access and/or use this site. These terms may change from time to time. All changes will be made available on this page, please review these terms regularly to ensure that you are aware of any changes made. All personal information supplied to us online via this website is held in confidence and in accordance with the Data Protection Act. You have the right at any time to ask us for a copy of the information supplied by you that we hold. We have the right to charge an administrative fee for this service. The server on which we store our in-house database is kept in a secure environment. It is possible that in the future Polka Party could be acquired by, or merge, with another business. Should this happen, we may share your personal information with the new owners of Polka Party, however, you will be sent notice of such an event.
